Justin's Secrecy



There will always be those unable to see beyond the obvious when it comes to Justin Trudeau. His sunny smile, his platitudinous assurances that we can have our pipelines and climate change remediation simultaneously, and his opaque insistence upon the necessity of an Infrastructure Bank seem to carry the day for some, apparently happy to suspend whatever critical-thinking capacities they may possess.

Unfortunately, this blanket belief in Trudeau's sincerity means that his neoliberal agenda is being under-scrutinized by the public. One of its most egregious manifestations is the secrecy around which the government has hired consultants to study the deliverance of our airports to private interests.

A secretive project to generate billions of dollars from the sale of major Canadian airports is pushing ahead with the hiring of consultant firm PricewaterhouseCoopers (PwC).

The firm is to "act as a commercial adviser assisting with additional analytical work with respect to advancing a new governance framework for one or more Canadian airports."
The shield of secrecy was peeled back only due to a freedom-of-information request from the CBC, coupled with some stellar sleuthing. The very fact that this project was withheld from public eyes is the first red flag.

But wait! There's more!
The new contract follows a report delivered last fall by Credit Suisse Canada on how Ottawa might gain billion-dollar windfalls through the sale of its interests in Canada's Big Eight airports and 18 smaller airports. The eight are in Toronto, Vancouver, Montreal, Calgary, Edmonton, Ottawa, Winnipeg and Halifax.

Credit Suisse was hired by CDEV, [Canada Development Investment Corp.] acting on behalf of Finance Canada, in a contract announced in a terse two-sentence release on Sept. 12.

The Crown corporation and Finance have since refused to release the Credit Suisse report, the contract terms or even the cost to taxpayers, despite requests by an opposition MP and by journalists.
And, again typical of the neoliberal orientation, private entities were given veto power over the release of information:
... the contracts with Credit Suisse and PwC contain clauses that give the firms vetoes over the public release of any information, including the cost of the work.
Why should any of us be bothered by any of this? There are many reasons, but Craig Richmond, the president and CEO of the Vancouver Airport Authority, recently addressed one of them when he said,
... prices for airlines and passengers would only increase as for-profit entities seek to make back their investments.

[He understands] the attraction of a one-time big profit for Ottawa, but "that's like selling the furniture in your house to cover your credit card debts."
Mr. Trudeau's government euphemistically refers to this whole process as "asset recycling." Those less enamoured of the Prime Minister and his band of sunny men and women, I suspect, would call it something else entirely.

Measuring Democracy



One of the concerns that has motivated me throughout the years I have written this blog is public accountability. Far too often, whether examining politics at the federal, provincial or local level, it is evident that public accountability, when it occurs, is often an afterthought, not a prime mover of our overlords. It is safe to say, I think, that ours is not a particularly healthy democracy, given that secrecy, obfuscation and misdirection far too often seem to prevail.

This proclivity seems to be the default position of those who govern us, and unfortunately, like the metaphorical disease that it is, it spreads and infects an array of institutions. This is egregiously evident when one looks at policing.

I have written extensively about the abuses of police power on this blog, and despite the fact that it happens with alarming regularity, there is little evidence that the police culture of secrecy is changing, given that it is aided and abetted here in Ontario by both Kathleen Wynne's government and the Special Investigations Unit (SIU), which is called in every time a police action results in either injury or death.

Because there are limits to even what I can endure psychologically, I have refrained from writing about the situation of Andrew Loku, a mentally ill man who was shot dead by police less than a year ago for allegedly wielding a hammer at his housing complex. The SIU report, as per tradition, remains a secret, even to the family of the deceased. All we are allowed to know is that the investigation exonerated the police from any wrongdoing.

Given the reactive nature of the Ontario government, a topic about which I wrote yesterday, it tried to placate public fury over the killing and subsequent secrecy by releasing part of the SIU report, a move that satisfied no one. It was truncated and heavily redacted.

The following letters from Star readers are ample testament to both the inadequacy of the report and the failings of our democracy:
Censored report raises more questions, April 30

Some 74 per cent of this report is secret. This abuses the very basic platform of transparency. The 26 per cent transparency shows how little respect for the voter the government really has. When public trust is bankrupt, remediation is needed.

I suggest that all such reports be made public within three months of receipt, the timetable verified by the Ombudsman’s Office. The report will contain no redactions that have not been approved by an independent council of legal experts and voters and shall be housed at arms-length in the Office of the Attorney General.

It is a sad day when I pick up the Star to learn that once again I’ve been blindsided by politicians “committed” to transparency. It’s a vote of no confidence by the politicians of the people. Public trust has never been so … redacted.

The abbreviated Special Investigations Unit report into the death of Andrew Loku is surely in its current form an insult to the intelligence of the people of Ontario. Here we have the attorney-general’s office hiding behind the convenient excuse that deletions are “a result of privacy and safety constraints as well as legal requirements,” delivering what is essentially a “nothing report” and no doubt keeping fingers crossed that the public will accept the whitewash.

Well, it is high time this government learned that we have had enough and that we want, no, we demand, answers. Too many men have died at the hands of police and it is time to put an end to the SIU charade that presents itself as the arbiter of an impartial judicial report.

So, what is going on? Is it Queen’s Park or the police union that is preventing us from learning what really happens when shootings occur? Or (perish the thought) are these two bodies in on the act together?

It is difficult to think of any other group that would seek to keep SIU reports confidential and it is long past time for decisive action. In such crucial issues the public has a right to know exactly what is going on.

The release of the SIU report into the death of Andrew Loku provides very little information that we don’t already know thanks to the daily reporting by the Star. The hiding of 34 pages of the report simply indicates that nothing has changed. We are left in the dark on key issues surrounding Loku’s death.

I continue to be amazed as to why a political party that has just won an election all of a sudden forgets that it should be reflecting what the vast majority of the people want and deserve. Instead, these Liberals ignore legitimate requests as is the case is here.

There is a strong need to know exactly how, why and by whom a man’s life was taken. This should not be a secret society. Who can possibly be against shining a light on terrible events?

Once again the dysfunction of our democracy to police the Toronto police is clearly demonstrated. The systemic problem of our democracy is evident when the civilian elected officials and appointees are co-opted by the secret system of policing to preserve its bad practices.

It’s not enough for the Star to demonstrate in its pages regularly the secrecy concealing the truth about one case – the problematic shooting of Andrew Loku and its subsequent cover-up.

Citizens, who are the many, who won’t or can’t administer their police, who are the few, have no right to claim that they are a democracy. Shame on us.

Government Secrecy Returns



Having lived for almost 10 years under a cone of silence and secrecy, Canadians can be forgiven for expecting more openness from the Trudeau government. That expectation appears to be a forlorn hope, at least if this is any indication:
The Liberal government is refusing to make public a recently completed assessment of the state of human rights in Saudi Arabia even as it endures criticism for proceeding with a $15-billion deal to ship weaponized armoured vehicles to the Mideast country.

Saudi Arabia, notorious for its treatment of women, dissidents and offenders, became the focus of international condemnation this month over a mass execution of 47 people, including Shia Muslim cleric Sheik Nimr al-Nimr, an exceptionally vocal critic of the ruling Al Saud family.

A country’s human rights record is an important consideration in the arms export control process that determines whether Canadian-made weapons can be exported there. The Saudi deal was brokered by Ottawa, which also serves as the prime contractor in the transaction.
As pointed out yesterday, Canadians have every right to be wary of this deal, given that the armoured vehicles are destined for Saudi Arabian National Guard (SANG), charged with protecting the royal rulers against internal threats.

Hiding behind the usual bafflegab of government, Canadian officials had this to say about the how the deal meets the criterion that the vehicles not be used against the Saudi people:
“A report on Saudi Arabia has been prepared for 2015 as part of the department’s annual process of producing human rights reports on numerous countries. This document is intended for internal Government of Canada use only, and, as such, will not be made public,” said François Lasalle, a spokesman for Global Affairs Canada.

The Liberal government is also refusing to release any information on how Ottawa will justify the export of armoured vehicles under Canada’s export control regime.

“For reasons of commercial confidentiality, Global Affairs Canada does not comment on specific export permit applications,” Mr. Lasalle said.
Perhaps another reason that the government has chosen opacity over transparency in this matter is the realization that they are fooling few Canadians here, the majority realizing this deal is one of economic and political expedience over principle and law.

Not a good beginning for our 'new' government.

Is Secrecy The New Canadian Norm?



The Harper regime is notorious for its virtual embargo on information. Muzzling of scientists, heavily-redacted Freedom of Information documents, regular obstruction of Parliamentary officers have become the norm. In light of these profoundly anti-democratic traits, one has to ask whether the paranoid control that obsesses the regime has filtered down to other levels of government and institutions?

'Privacy rights' have become the default position of far too many. The Harper regime uses it regularly whenever it wishes to avoid answering uncomfortable questions. One of the latest examples of this deplorable tactic is to be found in the case of Bashir Makhtal,
a 46-year-old who lived and worked in Toronto, [who] has been languishing in an Ethiopian jail in Addis Ababa since he was convicted of terrorism in 2009. He has always denied the charges.

Makhtal was arrested on the border of Kenya and Somalia in 2006 after fleeing Mogadishu and the fall of the Islamic Courts Union.
Initially refusing a deal for a prison-transfer back to Canada because he claimed he was innocent, last year he accepted it, but the federal government has done nothing to faciliate that transfer, says his cousin.

The Canadian government response to these allegations?
François Lasalle, a spokesperson for Foreign Affairs, told the Star that “to protect the privacy of the individual concerned, further details on this case cannot be released.”

Similarly, Zarah Malik, a spokesperson for Public Safety Canada, told the Star that “the Privacy Act prevents federal government officials from discussing the specifics of an offender’s case.”
Other institutions inspired by this 'sterling' example include the RCMP, which now is refusing to divulge the identities of car accident victims and other such tragedies, even homicides.

Says lawyer David Fraser,
"Not disclosing the information very likely makes their jobs easier, and not having to ask the next of kin or the family to disclose whether they can disclose this information, it's one less thing that they have to do," he said.

"It's always easier — we see this across government — to just point to the privacy legislation as a reason to not do something … to not provide information to the media."
This cone of silence is given critical scrutiny by The Toronto Star:
Until this year the RCMP released the names of victims with their consent or the permission of their surviving relatives. Now it says it must comply with Privacy Act, regardless of the wishes of bereaved families.

“I wanted people to know my sons,” said Mary Anne MacIntyre of Judique, a small Cape Breton Community where 19-year-old Morgan MacIntyre and his 17-year-old brother Jordan were killed in a car crash two years ago. “Being Victim A or Victim B is just, to me, feels so cold.”
So even with the family's permission, the RCMP is obdurately hiding behind the privacy justification.

The federal behaviour is now infecting local police forces as well. This past February, two men were shot and killed by an armed security guard in a Toronto McDonald's restaurant. And that is about all we are ever likely to know, since it was announced this week that the guard will not be charged.
“Investigators consulted Senior Crown Attorneys and provided an overview of the circumstances surrounding the deaths,” police said in a statement issued Wednesday. “It was determined that there would be no reasonable prospect of conviction, therefore no criminal charges would be laid.”
Here is what columnist Edward Keenan had to say:
Two men were shot and killed, in public, in February. Police know who did it, but they will not tell us. They say no charges should be laid in the case, but they will not tell us why, or give us the information they uncovered in their investigation. Police have security-camera video of the incident, but they will not show it to us.

Two people are dead, and the Toronto Police Service’s response, after four months of investigation, boils down to: Nothing to see here. Trust us. Move along.
This is police state stuff.
Make no mistake about it; there are many unanswered question that call into question the administration of justice here:
Was it a clear-cut case of self-defence? I could imagine a hundred scenarios in which that’s possible, but we don’t know.

Why was this security guard armed in a restaurant? We don’t know. What kind of work was he doing nearby? We don’t know. Was his life in danger? Was he being robbed? Was he defending other people?

We don’t know.
People who live in dictatorships are used to being kept in the dark. They have very low expectations. We still live in a democracy, albeit one under steady attack by repressive forces from within. As Canadians approach the October election, one of the many questions they will have to ask themselves is whether or not they are comfortable being treated as children excluded from the conversations at the 'adult table'. If they are not, they would be wise to choose a government that sets a tone of transparency, not obfuscation, for its citizens.

Privacy Concerns Or Just Plain Secrecy?



I started working on a post the other day about government and institutions' penchant for claiming 'privacy concerns' as an excuse for withholding the kind of information that true democracies are entitled to. However, I haven't had a lot of energy the past few days, so I think I will let Ontario Information and Privacy Commissioner Ann Cavoukian speak for me through a letter that was published in Today's Star.

Re: Unlicensed daycare complaints kept secret in Ontario, July 19

It really disturbs me when people hide behind privacy, using it as a shield to prevent much-needed scrutiny. Accordingly, I take issue with the statement by the Minister of Education that safety-related information of unlicensed daycares cannot be released due to “privacy concerns.” Privacy laws are not meant to protect individuals who break the law, nor to prevent the enforcement of safety requirements.

While I acknowledge there is a wide range of informal unlicensed daycare arrangements, it is the responsibility of the ministry to determine what it can release to parents proactively, according to the principles I have issued on Access by Design or the legislated provisions on disclosing information in compelling circumstances affecting health and safety. Parents should not have to file formal access requests for information the ministry holds that has an impact on the health and safety of children in unlicensed daycares — this should be made freely available. The ministry should not use privacy as a shield.
