When Is A Scab Not A Scab?

When (s)he is a 'replacement worker'.

I have always loved the word 'scab'. A fitting description of strikebreakers, it is a word that conjures up ugly imagery, imagery quite appropriate for those who act without integrity by engaging in strikebreaking behaviour, which are essentially shameless public declarations of individual extollment of the self over the collective good. There can be few lower forms of human than scabs.



During his time as Ontario Premier, Bob Rae passed legislation that banned these scourges, legislation that was repealed when Mike Harris, devoid of any semblance of integrity, became the next premier. Tellingly, subsequent Liberal governments were quite happy to continue his neoliberal labour view. Scabs therefore are alive and well in Ontario.

And yet, despite the fact that we live in a time when collective-bargaining rights are under regular assault by scabs and their enablers, the word itself seems to have disappeared from our lexicon. The euphemism, replacement workers, is an anodyne that attempts to conceal the ugliness of the act of strikebreaking. One is reminded of Orwell's observations about the insidious use of euphemisms:
Defenceless villages are bombarded from the air, the inhabitants driven out into the countryside, the cattle machine-gunned, the huts set on fire with incendiary bullets: this is called pacification. Millions of peasants are robbed of their farms and sent trudging along the roads with no more than they can carry: this is called transfer of population or rectification of frontiers. People are imprisoned for years without trial, or shot in the back of the neck or sent to die of scurvy in Arctic lumber camps: this is called elimination of unreliable elements.
Tamper with the language and you tamper with the reality.

Take a look at the following article, about an ongoing strike at a Goderich salt mine.
A rural community is rallying around salt mine workers who have been embroiled in a strike since April, a disagreement that has involved wooden pallet barricades, demonstrations and busloads of replacement workers.

The workers at the Goderich mine have been off the job since April 27.

Unifor Local 16-O represents the workers, and alleges Compass Minerals has been flying in replacement workers from New Brunswick to break the strike while demanding concessions that include mandatory overtime, reduced benefits and a weakening of contracting-out provisions.

In a letter to the community on June 28, Compass Minerals said it has used contractors to produce salt to fill long-term orders, and had little choice to do so in a competitive market.

The strike ramped up when workers blockaded an access road to the mining site this past week to express their frustration over the use of replacement workers. Photos posted on Unifor Canada’s Twitter showed wooden pallets stacked high in a barricade on the road. Videos also showed Unifor national president Jerry Dias walking out the replacement workers from the mine as onlookers chanted “Don’t come back!”

Representatives from local Unifor unions across the country have rallied at the picket line with the Goderich workers and flooded social media with solidarity. Lana Payne, Unifor Atlantic Regional Director, shared an open letter on Twitter that had been written to Laura Araneda, CEO of Vic Drilling, the company Payne says has been allegedly flying the replacement workers from New Brunswick to the Goderich mine.

“By crossing the strike line and doing the work of striking miners, Laura Araneda’s replacement workers are undermining the bargaining power of fellow miners,” she wrote. “The fact is, there is always somebody willing to do your job for a lower wage in more dangerous conditions.
Now do a quick reread, this time replacing the term replacement workers with scabs.

You can see how language choices have a great impact on how we perceive things.

Perhaps the ugly reality about scabs is best reflected by Unifor national president Jerry Dias:
“Crossing a picket line is shameful behaviour that cannot be tolerated,” ... no job is worth stealing food from another worker’s family.”

On The Minimum Wage And Tim Hudak's 'Bold' Plan For Ontario

Continuing on with the theme of the minimum wage, which groups in both Canada and the United States are demonstrating to significantly increase, The Star had a good letter in yeterday's edition that points out the hidden costs of having so many working for poverty-level remuneration.

The Star underscored a bitter truth with its editorial call for a minimum wage increase: “a lot of people are working hard to remain in poverty,” due to a minimum wage that’s been frozen for over three years. And, as you note, a great many people are affected: more than half a million minimum-wage Ontario workers directly, along with their family members.

It’s important to realize that we all pay the price of poverty-level wages, in many ways. More than 400,000 Ontarians must rely on foodbanks and emergency meal programs to ward off hunger. Many of them are working, but don’t earn to pay rent and meet other basic needs, including food. A minimum-wage increase would enable more of them to buy their own food — and would ease the burden on foodbank volunteers and donors. It would also raise demand at local food stores and other local businesses, thus boosting the local economy.

A fair minimum wage is a basic issue of justice. It’s also a key element of Ontario’s poverty reduction strategy, which has shown disappointing results in recent years. The minimum wage should be set at a level that ensures that work is truly a pathway out of poverty.

If Premier Kathleen Wynne is sincere about her professed desire to be the “social justice Premier,” she needs to affirm her commitment to real progress against poverty and quickly implement a substantial increase in the minimum wage.

On a related note, this video appeared on Alison's blog at Creekside, which I am taking the liberty of cribbing. Although 19 minutes in length, it is well-worth viewing, exposing as it does the kind of hollow and destructive policy advocated by Ontario Progressive Conservative leader Tim Hudak as he promises to bring in 'right-to-work' (i.e., union-busting) legislation should he become the next premier.

As the film shows, young Tim's promises about the prosperity that will ensue if we just get rid of 'those greedy unions that are hobbling the economy' have allure only if we choose to be willfully ignorant of the fact that such measures will lead to lower wages and even more precarious employment than currently exists:

Another Union-Busting Eatery I Will Not Patronize



Several days ago I commented on a story from The Star about the unsavory labour practices of Richtree Market, a Toronto restaurant that 'closed' its business, terminated all of its unionized staff, only to reopen this coming Monday a few doors down from its prior location. None of the old staff was rehired, and all who currently staff the 'new' operation are non-union, a clear violation of Ontario labour law.

In this morning's edition, The Toronto Star reports that the same tactic has been used by the Lai Wah Heen restaurant, housed within the exclusive Metropolitan Hotel in Toronto:

For 17 years, Ricky Chu served the lauded dim sum at Lai Wah Heen restaurant with a smile. The unionized job at the Metropolitan Hotel eatery fed his kids, after all.

When a new owner took over the hotel in January, the high-end restaurant was shut down. Chu lost his job. But he considered it salt in the wound when Lai Wah Heen reopened in March — without him or ten other servers who were laid off. In their place was a non-unionized staff.

The Metropolitan Hotel changed hands this year, being purchased by Bayview Hospitality Group. This fact, according to its president, Al Gulamani, gives it every legal right to treat over 100 of the hotel's former workers like disposable commodities.

Unite Here Local 75, the union representing them, disagrees, arguing that the owner has violated labour law and their collective bargaining agreement by shutting down certain departments only to subcontract them out.

Employment lawyer Howard Levitt says new ownership can’t break a union agreement, especially if the nature of the business hasn’t changed.

“It doesn’t matter if the ownership changes, there’s something called successor rights in the Labour Relations Act. Employers who think that just by changing ownership they can escape the union are unfortunately deluded.”


Meanwhile, employees in other departments of the Metropolitan live in daily fear that they will be next. One of those is Rahman Aliheidari, 49, pictured above, who fears the room service department at the Metropolitan Hotel, where he works, will next:

“I have a 4-year-old daughter. When I work, I have fear. When I sleep, I have fear. You call this a stable job?”

Indeed.

Thomas Walkom Today

The union movement is one of the last remnants of the great postwar pact between labour, capital and government.

That pact provided Canadians with things they still value, from medicare to public pension plans. Good wages in union shops kept pay high, even in workplaces that weren’t organized. Unions agitated for and won better health and safety laws that covered all.

True, union rules made it more difficult for employers to axe slackers. But they also ensured that when someone lost his job, it was for real cause — not because he or she had refused to sleep with the boss.

This brief excerpt from Thomas Walkom's column in today's Star serves as a timely reminder about both the historical and contemporary importance of the union movement. Entitled The teachers’ dispute and the war on wages, the piece posits that the Ontario McGuinty government's theft of collective bargaining rights under Bill 115 is really part of a much larger and endemic assault on good-paying jobs as governments and the corporate sector work together in advancing the latter's agenda.

One may rightly ask how an attack on public-sector workers advances that agenda. According to Walkom, well-paid teachers and other public-sector workers are a reminder of what is possible. As the writer asks, "How can employees be encouraged to accept the discipline of this new world when they see some, such as teachers and other public sector workers, still making good wages?"

Both federal and provincial governments, of course, are counting on the rabid resentment and antipathy against the public sector that is vigorously and consistently fanned by the business community.

And yet, there is evidence that the current Ontario teacher battle with the government, and the federations' argument that theirs is everyone's fight, is achieving some public resonance. A story by Robert Benzie and Kristin Rushowy reports that 49 per cent of Ontarians support the teachers.

If that is true, perhaps the collusive strategy between government and business needs revisiting.

The Not-So-Hidden-Hand of Harper

Although I believe unreservedly in the vital role that unions play in both protecting and promoting workers' rights, I make no apologies for the times that I have been critical of them. Cronyism, questionable expenditures, and corruption have no place in organizations meant to serve their members.

Nonetheless, the latest thinly-disguised attack against unions by the Harper regime goes beyond the pale, one that feeds into and exploits the inexplicable envy and antipathy felt by much of the public toward those responsible for helping their members earn a living wage.

Bill C-377, ostensibly a private member's bill put forward by Conservative MP Russ Hiebert, is getting help from the Prime Minister's office to modify measures that have touched off an unusual outpouring of concern from Canadians.

Denounced as a well-structured assault on trade union rights by MP Pat Martin, the bill,

...would require labour unions or any group involved in collective bargaining with an employer to provide Canada Revenue Agency with information annually on nearly all financial affairs, with the reports to be published on CRA’s website.

However, the information that would be required goes well beyond simple financial statements:

Required information includes every transaction or disbursement over $5,000 for conferences, collective bargaining activities, training, lobbying, political activity and payments to union officers and members. The same reporting requirement applies to all investment trusts and funds operated by unions on behalf of their members. The name and address of each person involved in any of these transactions would have to be reported to CRA and would be made public.

Especially vexing is the arrantly hypocritical Harper justification for this information, with Hiebert claiming

...the bill is in keeping with the Harper government’s attempt to promote transparency and the public has a right to know how unions spend their members’ dues, which are tax deductible and according to Hiebert cost Ottawa about $500 million in foregone revenues a year.

Transparency and lost tax revenue are concerns of this government?

Really?

Ontario's Impending Austerity Budget

Reading my morning Star, I learned that there is wide-spread support among the public for austerity measures to reduce Ontario's deficit. I suspect that there will be a particular appetite for the following:

Hundreds of thousands of teachers, nurses and all other public employees face higher pension contributions or reduced payouts to keep their plans sustainable, the Ontario government will announce Tuesday.

Although I am a former teacher receiving one of those 'lavish pensions' that come with no benefits (I pay about $3,000 per year for supplementary health insurance), I shall not use this space to offer a defense of them, except to observe that the money for that pension comes from a hefty percentage deduction of my salary over the years, along with the government's contribution.

No, what I really want to say is that the reaction of the various public sector union leaders to this austerity program with be a telling barometer of the health of the union movement provincially and nationally.

Conventional wisdom is that unions in North America have been under attack for some time, and the success of that attack is clear in the erosion of union membership over the years; however, unions have to take part of the responsibility for that decline, frequently serving the members with the less-than-sterling leadership they deserve, a topic I have written about on more than one occasion.

For example, after the divisive and hateful reign of Mike Harris and his comrades came to an end in Ontario, the leadership at OSSTF, my former federation, embraced Dalton Mcguinty and his policies uncritically, and I believe it was at that point, to borrow a thought from Chris Hedges and his Death of the Liberal Class that the union, a traditional liberal institution, failed to hold true to its values, instead essentially giving its stamp of approval to everything the government did, thereby selling out to the corporate agenda.

So, in what looks to be a major budgetary attack on the public sector, how the unions respond could give a very good indication of their future health and viability.

How The Harper Government Defines Efficiency At The CBC

While it will likely come as no surprise to many, the Harper Government has within its sights the CBC, the sometimes irksome public broadcaster that the right-wing so often loves to hate. As reported online in today's Globe, the Heritage Minister, James Moore, says that a 5% federal funding cut should not be onerous for the Corporation.

Perhaps part of the larger Tory agenda, not just for the CBC but the country as a whole, was revealed in the following statement by the Minister:

“The truth is the CBC is finding efficiencies. The CBC used to have nine unions. Now there are six. They’ve sold assets that, frankly, they weren’t using.”

So, it would seem that union-busting and asset sales form an important part of the long-term strategy of these self-proclaimed master managers of the economy.

One can only shudder when considering the future shape of this country.
